Summer to fall 2023: The lawyers of Bruppacher Anderes advise a globally operating company from the medical sector on the sale of a business division as part of an asset deal under Swiss law
In the summer to late fall of 2023, the lawyers of Bruppacher Anderes, in cooperation with their partner law firms in the USA and Germany, were able to advise and support an internationally active company from the medical industry in the sale of a business division. Upon the due diligence, the sale - which was originally structured in the form of a share deal - was adjusted during the course of the further negotiations and ultimately the sale agreement was set up and successfully completed in the form of an asset deal under Swiss law.
May 2023: The attorneys-at-law of Bruppacher Anderes successfully represent the brewery BierVision Monstein AG against the American billion-dollar corporation Monster Energy in a trademark opposition lawsuit
The attorneys-at-law of Bruppacher Anderes are pleased that the Swiss Federal Institute of Intellectual Property (IGE) has followed their legal opinion that a confusion of the trademark "Monster" and the contested trademark "Monsteiner" is not likely. Monster Energy argued unsuccessfully that the term "Monster" is included in the trademark "Monst [- a -] er," which could potentially result in a of confusion of the two trademarks among the target audience. The IGE rejected Monster Energy's trademark opposition in its entirety, thus confirming the argumentation of the attorneys-at-law from Bruppacher Anderes. 2022
November 2022: The lawyers of Bruppacher Anderes advise their international clients on the structuring of corporate and third-party loans
In the period from summer to autumn 2022, the lawyers of Bruppacher Anderes advised their international corporate clients on the granting of various loans to group companies within the group or to third parties and drafted the respective contracts in cooperation with the foreign law firms involved. In addition to questions regarding the applicable law, which were answered by choosing Swiss law, the drafting of the contracts also raised questions regarding the securing of the respective loans in the form of promissory notes pursuant to Art. 842 et seq. CC, guarantees in the sense of Art. 111 CO or sureties in the sense of Art. 492 ff. OR, which, in contrast to guarantees, are subject to very strict formal requirements, the non-observance of which leads to the invalidity of the respective contracts. The lawyers of Bruppacher Anderes are pleased that all transactions could be settled to the satisfaction of their clients and would like to thank the foreign law firms for their professional cooperation.
November 2022: Federal Supreme Court ruling of 17 October 2022: Employer subsidies for daycare centers are subject to AHV contributions
Subsidies paid by the employer for the benefit of employees for childcare in a company-owned or affiliated daycare center (“KiTa”) are subject to AHV contributions. Childcare center subsidies cannot be considered family allowances, which would be exempt from the obligation to pay AHV contributions. The Federal Supreme Court upholds a complaint regarding the daycare subsidies paid by the University Hospital Basel.

April 2022: Change of company name to Bruppacher Anderes KIG
The lawyers of Bruppacher Hug & Partner are pleased to announce that the law firm, which has been operating under the name Bruppacher Hug & Partner since 1993, will be managed by the two partners, Dr. C. Mark Bruppacher and lic. iur. Dominique Anderes, under the new name Bruppacher Anderes KlG as of April 2022. With the revision of he laws governing the company names, general partnerships are obliged to include their legal form in the company name, which explains the addition KIG. The lawyers Mark Bruppacher and Dominique Anderes would like to thank their clients for the trust they have placed in their firm for almost 30 years and look forward to working with their clients and partners in Switzerland and abroad in the future.

March 2022: Dominique Anderes in the magazine Finanz und Wirtschaft of March 26, 2022 on shareholders' rights
Attorney-at-law Dominique Anderes answered questions on shareholders' rights to information and disclosure under the current stock corporation law still in force today with reference to the revised stock corporation law, which will come into force in 2023. Among other things, the revised stock corporation act provides for a strengthening of the legal position of shareholders.
